International Conference on Intellectual Property System in Asia

On December 10, Nagoya University Graduate School of Law held an international conference titled "IP System in Asia: Convergence and Harmonization of IP System in Asian Countries" at the Asian Legal Exchange Plaza. It was convened in connection with the research project supported by JSPS Kakenhi Grant (17H00963) conducted by Professor Masabumi Suzuki as the PI.At the conference, eleven young specialists from abroad (Cambodia, China, Malaysia, Taiwan, Thailand, Turkey, and Vietnam) gave presentations. All of them were former students in the doctoral program of NUGSL. Several senior scholars from Japan, China, and Germany were also invited as commentators, and many former and current graduate students were in the audience.While the current status of efforts to harmonize IP systems in the EU and Asia was clarified, it was also explained that each country has its own specific problems regarding IP protection. The conference was also an opportunity to build and strengthen a human network among young experts from NUGSL, as well as senior researchers from other countries.

Nagoya University Graduate School of Law takes part in the UNCITRAL Asia Pacific Day 2022

On December 13, 2022, Nagoya University Graduate School took part in the UNCITRAL Asia Pacific Day 2022 with a workshop titled "The Role of Arbitration in Legal Harmonization. An East Asian Perspective". The event was attended by 20 participants from 12 different jurisdictions.The workshop was opened by an introduction by Prof. Giorgio Fabio Colombo of Nagoya University Graduate School of Law on the importance of arbitration in the framework of legal harmonization. Then, Mr. Tony Andriotis, Partner at DLA Piper in Tokyo and JCAA Institutional Relations Officer offered a presentation on the role of arbitral institutions in creating common practices. Dr. Julia Jiyeon Yu, Lecturer at Kyushu University, presented on the arbitrability of IP disputes in some selected jurisdictions, with a specific focus on East Asia. The event was closed by the conclusion by Prof. Dai Yokomizo of Nagoya University Graduate School of Law, who offered some critical remarks about the challenges of harmonization. Nagoya University Graduate School of Law continues its tradition of taking part in the UNCITRAL Asia Pacific Day, and we look forward to the 2023 edition.

Special Lecture on “Trust Law vs. Ownership Concept in Civil Law: Mongolian Example”

On December 6, the special lecture entitled “Trust Law vs. Ownership Concept in Civil Law: Mongolian Example” was given by Prof. Oyuntungalag Jargalsaikhan, Chief Judge on the Civil Appellate Court of Capital City of Mongolia.In 2010, she received her LL.D in civil law from the Graduate School of Law at Nagoya University. Currently, she is conducting research as a visiting associate professor at Keio University.Professors and graduate students of the Graduate School of Law participated in the lecture. They listened attentively to her presentation and discussed the Japanese and Mongolian legal systems. The content of the lecture, which included Mongolian cases, greatly interested the participants, and a lively question-and-answer session was held after her presentation.This lecture was organized jointly by the Graduate School of Law and the Center for Asian Legal Exchange (CALE).

Dr. Phan Thi Lan Huong was awarded

Phan Thi Lan Huong has worked for Hanoi Law University in Vietnam since 1997 with a background in Administrative Law with a focus on human rights protection and rule of law state. She received the MEXT scholarship first time in 2001 for enrolling in the LLM Program at Nagoya University. In 2003, she received a Master of Laws Degree and went back to work at Hanoi Law University. In 2009, she enrolled the LLD Program and received a Doctor of Laws Degree after 3 years. In 2014, Phan was appointed as the Deputy Head of the International Cooperation Department. Since then, she also supports collaboration between Hanoi Law University and Nagoya University. She works as a coordinator for the Japanese Law Center as well as the Head of the Representative Office of Nagoya University in Vietnam since 2014. In 2022, she was recognized as an Associate Professor title by the National Council for Professorship in law major. In addition, she was awarded a Memorandum Medal in recognition of her contribution to education in Vietnam by the Minister of Education and Training.

Prof. Kong Phallack was appointed as the Secretary of State of the Ministry of Post and Telecommunications of the Kingdom of Cambodia

Professor. KONG Phallack was appointed as the Secretary of State of the Ministry of Post and Telecommunications of the Kingdom of Cambodia pursuant to the Royal Decree No.NS/RKT/0822/1016 dated 24 August 2022. He obtained an LLM in Law and Politics (Nagoya University, Graduate School of Law, Japan in 2001. He has 21 years in teaching and 20 years in law and policy development including legal practice and mediation. He has been engaged in mediation on social and environmental disputes impacted by the business as well as resolving labour disputes. He has written laws, policies papers and books related Cambodian Laws. His publication includes Introduction to Cambodian Law (2012), Cambodian Constitutional Law (2016), Contemporary Environmental Law in Cambodia and Future Perspectives (2020), Perspectives on Cambodian Constitutional Law (2020), Contemporary Cambodian Employment and Labor Law (2021), and Law in the Digital Age: and Protection of Consumer Rights (2021). His contribution to development of laws and policies are legal and judicial reform, ombudsman, telecommunications, post, cybersecurity, and personal data protection, public private partnership, social protection, social security, persons with disabilities, environment, health and so on.

H.E Mr. KANG Daravuth was appointed as the Independent Commissioner of Cambodia Competition Commission

H.E Mr. KANG Daravuth was appointed as the Advisor to State Secretariat of Civil Aviation of Cambodia by His Majesty the King of the Kingdom of Cambodia pursuant to the Royal Decree No. 0422/398 dated 20 April 2022, and as an Independent Commissioner of Cambodia Competition Commission by Samdech Aka Moha Sena Padei Techo HUN SEN, Prime Minister of the Kingdom of Cambodia pursuant to the Royal Government of Cambodia Decision No. 47 dated 14 July 2022.H.E Mr. KANG Daravuth is the Independent Commissioner of Cambodia Competition Commission (“CCC”) and the Advisor to State Secretariat of Civil Aviation (“SSCA”) with a rank of Under-Secretary of State. He is the Partner and Head of Practice Group of Corporate and Business Combination, Litigation and Dispute Resolution at GCL Law Group. He is a lawyer and member of the Bar Association of the Kingdom of Cambodia (“BAKC”). He is a commercial arbitrator and member of the National Commercial Arbitration Centre (“NCAC”). He obtained a Master of Law (Comparative Law) in 2013 from Graduate School of Law, Nagoya University. His field of study at Nagoya University is International Commercial Arbitration.

Professor Emeritus Masanori Aikyo was awarded an honorary doctorate from Hanoi Law University

On June 29, 2022, Hanoi Law University awarded an honorary doctorate to Masanori Aikyo – a Professor Emeritus of Nagoya University (currently serving as the President of Aichi Prefectural Public University Corporation).Professor Aikyo has been involved in the academic exchange between Hanoi Law University and Nagoya University. He particularly played important role in the conclusion of an academic exchange agreement between two universities in 1999 and the establishment of the Research and Education Center for Japanese Law at the Hanoi Law University in 2007. He specializes in Vietnamese constitutional law and was involved in the Japanese government’s legal assistance project to Vietnam since the initial stage in the mid-1990s. In 2015, the Vietnamese Ministry of Justice awarded him a medal in honor of his achievements. This time, Hanoi Law University awarded him an honorary doctorate.At the ceremony, Doan Trung Kien, Rector of Hanoi Law University, presented him with an honorary doctoral degree, and Dang Hoang Oanh, Deputy Minister of Justice, his former student at Nagoya University gave a congratulatory speech.
